Architectural Controls

Restrictive Covenants
Relating to Lots 4 to 48 Inclusive, Block 1, Plan 062 6999
Pursuant to Section 52 of the Land Titles Act of Alberta, Dwayne Bunch and Gary Dietrich as owners of the
above noted property hereby annexes to the property the following restrictive covenants and conditions.


1.

This restrictive covenant applies only to construction on the property completed after the date of this instrument, all improvements on the property including buildings and perimeter fences as they exist as of the 1st of September, 2006 shall be exempt from the conditions and restrictions contained herein.  

2.

No excavation shall be permitted or carried out on any property except as required for the construction of buildings, or the installation of utilities, or for landscaping.  No sand, gravel, or earth shall be removed except as required for the aforesaid purposes.

3. Any dwelling or structure constructed, erected, or placed on the property shall be constructed to conform to all Federal, Provincial, and Municipal statues, by-laws and regulations including any fire safety regulations or by-laws in place from time to time with the relevant authority.
4. No dwelling shall have a ground floor living area, excluding garage area, of less than 1300 square feet.
5. None of the following construction types will be allowed as the dwelling:
 
  1. “Moved-In-Building” means a building for which approval is being sought to relocate the building from the parcel of land on which it is presently located to a proposed parcel of land.
  2. “Modular Home” means a prefabricated, factory-built residential building containing one dwelling unit which has neither a chassis, running gear, nor its own wheels, but which must be otherwise transported to a site and placed on a permanent foundation and connected to utilities for long-term occupancy.
  3. “Manufactured Home or Mobile Home ” means a residential building containing one dwelling unit built in a factory in one or more sections, designed to be transported or neither its own wheels and chassis or other means to a suitable site, and place on either a temporary or permanent foundation and connected to utilities for long term occupancy.
  4. “Quonset Style Home” means a building that is constructed in the manner of a ancillary storage building that is being built for the purpose of using as a dwelling
  5. "Round / Golf Ball Style Homes” mean a building that is constructed in a circular shape that does not conform to standard square type construction in the sub-division.
6. All electrical service from the transformer to the dwelling or other buildings, and between any buildings, shall be underground.
7. The exterior finish of any building or structure shall be fully completed and finished within eighteen (18) months from the date of commencement of construction of the dwelling or structure.
8. To maintain a buffer area between dwellings, no living trees shall be removed from that portion of the lot within five (5) meters of any property line, except for any property line adjacent to any public access road.
9. Wire fences may be used within any property, but no wire fence shall be used as a boundary/perimeter fence.  No boundary/perimeter fence shall exceed 1.5 meters in height.  All fencing shall be designed, placed and finished so as to be complementary to the dwelling on the property, and shall be maintained in a good and presentable condition.
10. All garbage and refuse shall be properly stored in closes containers in a sanitary manor so as not to cause any odor or nuisance. (No garbage burning barrels).
11. All pets and other animals shall be restrained and kept within the property owned by the owner of such pet, so as not to cause any nuance, annoyance, or excessive noise.  When off the owner’s property all animals shall be properly controlled and supervised by the owner.
12. No Abandoned vehicles, machinery, or other unsightly items shall be kept or stored on any property, except within a building with the intent that all properties shall be dept in a neat clean, and presentable condition.
13. .No business, trade, or calling shall be established which requires outside storage, or parking of equipment, which would cause any noise or nuisance to other property owners, or which would cause any unsightly appearance to the property
14. The covenants contained herein shall be registered against the titles for the properties and shall be considered to be covenants running with the land, and shall run with the land from the date of registration in perpetuity. The covenants shall enure to the benefit of and shall be bindings upon any future purchaser, owners, or lessees of the property, and may be enforced through the courts of the Province of Alberta.
15. Any amendment, addition, or deletion to or from the within covenants may be made only with consent in writing of seventy-five (75%) percent of the owners of the properties affected by these covenants.
